Kathmandu. The Supreme Court has issued a short-term interim order not to appoint a person who has completed 65 years of age as the Governor of the Nepal Rastra Bank. On Tuesday, a single bench of Justice Nityanand Pandey issued a short-term interim order not to immediately appoint a governor who has completed 65 years of age.
On February 26, 2081, the Ministry of Finance amended the criteria for the appointment of officials related to the Ministry of Finance. Provisions regarding qualifications for appointment have been made in Section 3 of the criteria. In the previous criteria, (a), (b), (c) were included in the qualifications for appointment in Section 3. Now (c) of that criterion has been removed. In the previous criterion c, it is mentioned that ‘in the case of the Chief Executive Officer, thirty years of age and in the case of other officials and members other than the Chief Executive Officer, thirty-five years of age and not exceeding sixty-five years of age.’ Now that provision has been removed.
A writ petition has been filed in the Supreme Court after preparations were made to appoint a person above the age of 65 as governor by changing the criteria in the interests of middlemen. Advocates Pratibha Upreti and Vishal Thapa filed the writ petition. The petitioners had sought a mandate from the court as the age limit of 65 years is required in all areas of government appointments.
The Nepal Rastra Bank has been without a governor since Chaitra 24. Regarding the appointment of governors, the Nepal Rastra Bank Act itself has made a provision that the appointment should be made 1 month before the end of the governor’s term. However, the government is delaying the appointment of governors by amending the law by appointing an acting governor.
