Kathmandu. The government is preparing to file a case in the Supreme Court alleging that it did not follow the law in the appointment of the governor.
Senior Chartered Accountant Bheshraj Luitel is preparing to file a case, alleging that the delay in the appointment of the governor was in violation of the law specified in the National Bank Act. After the government delayed the appointment of the governor, CA Luitel has sought information from the Ministry of Finance on Chaitra 27.
After seeking information from the ministry, CA Luitel is preparing to go to the Supreme Court. CA Luitel has requested information from the Ministry of Finance in accordance with Article 27 of the Constitution of Nepal, 2072, on the Right to Information, and Sections 3 and 7 of the Right to Information Act, 2064.
He has asked various questions to the government, seeking information. He asked, “According to Article 25 of the Nepal Rastra Bank, the appointment of a governor should be made one month before the end of the term of the incumbent governor. What is the reason for the government’s failure to appoint a new governor?
Does the Government of Nepal have the right to not follow any provision of the Act of Nepal? Now, according to which law will it make appointments? Which law allows them not to work on time? Is this an improper act according to the Commission for the Investigation of Abuse of Authority Act 3 or not?”
If there is no appropriate response, Luitel has prepared to file a writ petition in the Supreme Court. Former Governor of the Rastra Bank, Maha Prasad Adhikari, has left after completing his 5-year service on Chaitra 23. Although the Rastra Bank Act states that the appointment of the governor should be made one year in advance, the government has not yet been able to appoint a governor. The government has formed a selection committee under the leadership of Finance Minister Bishnu Prasad Poudel to recommend a governor. The committee includes former governor Vijayanath Bhattarai and economist Dr. Bishwa Poudel.
