Kathmandu. Nepali Congress leader and MP Bishnu Kumar Karki has been blacklisted by the Credit Information Center. MP Karki has been blacklisted after failing to repay a loan from Kumari Bank Limited.
The Center published a notice on 20 Poush 20, 2080 and included his name in the blacklist. After the Center included him in the blacklist, ethical questions have arisen regarding his continued membership in the parliament. Section 13 of the House of Representatives Election Act 2074 BS contains a provision regarding the disqualification of candidates. In (h) of that section, the sentence ‘for the period during which he is blacklisted in accordance with the prevailing law’ has been included. This sentence has created a moral crisis for MP Karki’s position.
However, the act has added a legal complication that if a person is blacklisted, he will not be able to stand for election, but if he is blacklisted, he will not be able to hold office. The law on the suspension of MPs seems to be slightly different from the act. Section 248 of the House of Representatives Rules 2079 BS contains a provision regarding the suspension of MPs. That section provides for automatic suspension in cases seeking imprisonment for more than three years. Similarly, even if the Commission for the Investigation of Abuse of Authority files a case, the MP’s position is suspended, and the position will also be suspended in cases related to money laundering.
MP Karki admitted that the accounts with Kumari Bank have not yet been reconciled. MP Karki told Singha Durbar, “I have already asked to cut the land and take it away, but it has not been agreed upon. I have no complaints with the bank.”
Karki is a public representative elected from Nawalparasari (Bardaghat Susta Purbu) 2 in the 2079 BS House of Representatives elections.
This is the controversy
Kumari Bank Limited Branch Office Siddharthnagar, Rupandehi had some time ago given a loan to New Manakamana Brick Factory Pvt. Ltd., which is invested by MP Karki. The bank has published three generations of details along with a 35-day notice in the Kantipur Daily on December 18, 2080. In the notice, it has been alleged that the borrowers have violated the terms and conditions of the loan with the bank by not paying the principal, interest, penalty interest, etc., even after repeated written and verbal notices to the bank.
Karki’s company Pvt. Ltd. No. 5552/053 / 54 and received a certificate of permanent account number 301677147 from the Internal Revenue Office Butwal, Rupandehi on 2066 / 08 / 19, and is located in Rupandehi District, Parroha Village Council / N.P. Ward No. 06, New Manakamana Brick Factory Pvt. Ltd. This company has not filed taxes since the fiscal year 2076/077.
Karki’s property up for auction
After MP Karki failed to pay the interest on the loan on time, the properties he had pledged to the bank have been up for auction. The property registered in Karki’s name at the Land Revenue Office, Butwal, Rupandehi, is located in Paroha N.P./ G.B.S. Ward No. 6/A, located in Kitta No. 127, 139, 397, 394, 141, 267, 273, 504, 581 and 113 respectively have areas of 0-0-11, 0 1 4 0 1 2 0 2 17, 097, 03-11.5, 0-2-4, 1-13-19, 0-8-020-2-5 (B.K. Dhu.), A.A. Ward No. 5 / Kha has been auctioned with area of 0-9-16 (B.K. Dhu.) of plot no. 565.
Karki Kai has registered the land in the name of the Land Revenue Office Kawasoti, Nawalparasi (B.S. Pu) in the Nawalparasi (B.S. Pu) district Kawasoti N.P./Ga.V.S. Ward No. 6 A located in Plot No. 617, area 0-1-1 (B. K. Dh.) The bank has put up the land for auction.
Karki has registered the title deed in the name of Land Revenue Office Kawasoti, Nawalparasi (B.S.P.) in the name of Karki in Tamsaria N.P./Ga.B.S. Ward No. 9 A located in Plot No. The bank has initiated the auction process for the land of 760, 981 278 and 761, with areas of 0-10-0 0-6-5.25, 0-8-5.5 20 16-12 (B.C. Dh.) respectively.
