Myagdi. The District Attorney’s Office has registered a case against 25 people, including the head of the District Coordination Committee, Rajkumar Thapa, claiming an amount of Rs 1.13 billion in the case of embezzlement of funds from the Kumari Multi-Purpose Cooperative Organization in Beni.
After an investigation conducted by the District Police Office on the recommendation of the Cooperative Registrar’s Office, Pokhara, the Government Attorney’s Office filed a charge sheet with a demand and claim against them in the Myagdi District Court on Thursday.
It has also been demanded that further investigation and action be taken against him as he has violated the Cooperative Act, 2074, Regulations 2075 and the organization’s regulations by causing losses to the shares and savings deposited in the cooperative, the organization’s assets and external debt, and the revenue of the Government of Nepal. .
District Court Information Officer Dilliram Poudel informed that the closed hearing will begin from next Sunday regarding the charge sheet registered under Section 32 of the Criminal Procedure Code, 2074 BS.
‘Due to lack of time, the charge sheet received has only been registered,’ he said, ‘the closed hearing will begin from Sunday.’ The current and former office bearers, members of the cooperative’s board of directors, coordinators and members of the accounts and loan committees have been made defendants.
Five people arrested on Magh 20, 2081 BS and one person arrested on Falgun 7, 2081 BS are in police custody and 19 people are absconding. The police, the attorney general’s office, and the court have not made the names of the unarrested accused public, citing that the investigation would be affected.
36-year-old Thapa Kumari of Beni Municipality-1 is the former secretary, vice-president, and office-bearer of the cooperative’s loan committee. Thapa, who was elected as the head of the District Coordination Committee from the CPN (UML) in the 2079 BS local level elections, was the former district deputy secretary of the party.
The investigation has confirmed that Thapa embezzled Rs. 175.863 million from the cooperative. The investigation revealed that Rudra Gurung, 53, of Jaljala Rural Municipality-3, Parbat Beni, embezzled Rs. 135.948 million.
According to the investigation report, Devi Kumari Thapa, 49, of Beni Municipality-1, the secretary of the cooperative, former joint secretary and member of the accounts committee, has embezzled Rs. 37.146 million and Man Prasad Thakali, 67, of Raghuganga Rural Municipality-5, has embezzled Rs. 58.266 million.
A case of Rs. 45.594227 has been filed against Tham Bahadur Garbuja, 66, of Annapurna Rural Municipality-7, former treasurer, former chairman, and former loan committee member, and a former member of the accounts committee. Lok Bahadur Pun (Lokesh), 37, of Beni Municipality-4, has embezzled Rs. 21 million 46 thousand 44.
The investigation report states that those who are absconding have also misappropriated at least Rs. 52 million 93 thousand to Rs. 74 million 44 million. The police conducted the investigation based on the investigation report of the Cooperative Registrar’s Office, interrogation of the arrested persons, study of documents and evidence, and complaints of the victim savers.
The investigation revealed that the officers of the committee were put under pressure on the Steering Committee, Loan Subcommittee, and Accounts Supervisory Committee, creating a compelling situation for them, taking complete control of the organization, holding the keys to the entire system, conducting incorrect audits, publishing false reports, conducting unauthorized transactions, embezzling the cooperative’s funds, and buying and selling private property in their own names to gain illegal benefits.
The cooperative was defrauded by purchasing and integrating private property, disbursing funds to private companies, illegally using the cooperative’s funds for treasury transactions, and violating the Cooperative Act and Loan Act as per prevailing laws. The indictment alleges that the cooperative disbursed loans exceeding 10 percent of its capital fund without fulfilling the process criteria, disbursed loans without adequate loan analysis and security while disbursing loans, misappropriated funds in the name of advances, misappropriated funds by showing loans, misappropriated funds by providing shares to a limited number of people and obtaining life insurance to benefit from the cooperative’s funds, misappropriated income without paying the loan obligations they had taken, misappropriated funds by writing off interest as expenses, and misappropriated funds by setting interest rates on savings higher than loans in violation of the Cooperative Act and the law.
