Stating that there is a problem of transportation of illegal goods and import of sub-standard goods due to the open border, the lawmakers have said that the Export Import Bill should address it. The lawmakers said this while speaking at a meeting of the Industry and Commerce and Labour and Consumer Welfare Committee under the House of Representatives on Monday.
They said that the bill should be enriched so as to remove the problems seen in the export and import of goods and services. Speaking at the meeting, CPN (Maoist Centre) lawmaker Mahendra Bahadur Shahi said the bill was focused on framing regulations despite many problems related to export and import of goods and services.
He said that there would be a problem of conflicting ideas while moving the act in such a way that all the provisions would be made through regulations. Stating that nepal has an open border, illegal export of goods is being imported, he said that it is necessary to control it. How will this bill control the problem of import of sub-quality materials? He even asked questions.
He said, “The focus was on making this act in the rules. There will be problems tomorrow when the rules are made, the intentions will be in conflict. So why is it said that all arrangements should be made through regulations? It needs to be clear. Secondly, since Nepal has an open border, there are problems of exporting and importing illegal goods. Now there is a problem of quality as illegal transportation is taking place. How can this bill monitor and control this problem? We need to think about it. Another is the complexity of customs. There are also many complications in import and export. This bill should remove the complexities in bringing and sending goods. This customs act and export import act also seem to be in conflict with each other. ’
Nepali Congress lawmaker Kantika Sejuwal said that the machines to check the export imports have been damaged. She expressed apprehension that goods were being imported illegally due to the breakdown of check-pass machines at most of the checkpoints.
He complained that the issue was not heard even when it was raised in the House. She also stressed the need to change nepal’s law-making framework. She said that the language of laws and acts is not simple and normal, so there are challenges in the implementation. Stating that citizens get entangled due to the words ‘as prescribed’, ‘as stated’, ‘mentioned’, among others, she stressed the need to make laws simple and understandable to all.
“I think we need to change nepal’s law-making framework,” she said. The language of our law is not simple and ordinary. I wonder when we’ll make smart laws. When will a simple law be made for the general public to understand? I want to ask the secretaries. It is confusing people in such a way because of the terminology of bojim as mentioned above, as prescribed, as stated above. It is difficult for those working in the administrative field, it is difficult to explain to the common people. Such complex languages in this law should also be corrected. ’
CPN (UML) lawmaker Hemraj Rai stressed the need of importing technology as a service. Although the government has given priority to the technology sector in its policies and programmes, it is silent on the act, he said.
“We had said in the policies and programmes and budgets of the current fiscal year that we will do a lot of work in the field of technology. How many billion rupees are we still earning annually? Why is the government silent on the issue related to the export of technology? ’
Most of the lawmakers who spoke at the meeting drew the government’s attention to the possibility of conflict between the Export Import Act and the Customs Act. They stressed the need to bring a bill to solve the problem of transportation of illegal goods and import of sub-standard materials in the long run.
