Government insulted Parliament by introducing ordinance: Opposition parties

Kathmandu. MPs have expressed their views on the ‘Ordinance to amend some Nepal Acts related to the promotion of good governance and public service delivery’ brought by the government. The MPs expressed their views while participating in the discussion on the ordinance held in the House of Representatives on Wednesday.

Unified Socialist MP Bhanubhakta Joshi demanded rejection of the ordinance to amend some Nepal Acts related to the promotion of good governance and public service delivery.

He claimed that the ordinance was wrong in terms of process and content. He accused the government of bringing an ordinance in difficult situations, but instead of running the House in normal times, it brought an ordinance.

He said, “I would like to demand that the ordinance made to amend some Nepal Acts related to promoting good governance and public service delivery be rejected. I would like to state here that this ordinance is not right not only in terms of procedure but also in terms of content. We all know that this was not a transitional period or a situation of discomfort. The government has given the government of Nepal the discretion to bring an ordinance if it is necessary to do something immediately by calling the House, when it is difficult or inconvenient, that is natural.” If such a law had to be brought, all the honorable members of this House would have participated, but even though the opposition is asking for the House to be run, the government is preparing an ordinance instead of running the House.’

CPN-Maoist Chief Whip Hitraj Pandey accused the government of insulting the Parliament by bringing the ordinance. He said that it was wrong to bring the ordinance when the government had presented the bill related to financial procedures to the Finance Committee.

He said, ‘The ordinance issued in the current situation when a session of Parliament can be called is inappropriate. The government has already presented the bill in the Finance Committee as a law. Regarding the financial procedure, it has not even been withdrawn. The way the government has brought the ordinance without even withdrawing it has insulted the House, minimized the House.’

Rasty Swatantra Party MP Shishir Khanal said that the government should confirm the reason for bringing the ordinance. He accused the government of usurping the powers of the legislature through the ordinance.

He said, ‘The government cannot pass the ordinance without confirming the justification. This is important. It is the government’s responsibility to confirm the justification. But what were the amendments to the 12 proposed acts that could not have been made in the current situation? We must demand that answer because the government has snatched our collective right to the legislature through the ordinance.’

Nepal Workers and Peasants Party MP Prem Suwal said that the government should apologize to the people for bringing an ordinance in the normal situation of the country. He alleged that trying to run the state through an ordinance is the introduction of an autocratic government.

He said, ‘It is not appropriate for democrats to run the government by issuing an ordinance in the normal situation of the country. Doing so is the introduction of an autocratic government. It would be appropriate for the government and its parties that issued the ordinance to look in the mirror and apologize to the people to wipe their retrograde faces.’

CPN (Maoist Center) MP Durga Rai said that bringing the ordinance by circumventing the parliament is against the democratic system. She accused the government of trying to run the government through the ordinance.

She said, ‘It is clear that the government is trying to run the government through the ordinance, making the sovereign parliament seem irrelevant. The ordinance has not been issued in accordance with the spirit of the constitution. It should be used in cases of legal difficulties during the transition period, but it is against the democratic system to bypass Parliament and bring an ordinance even when there is a sufficient possibility of Parliament functioning.

MPs have said that while the ordinance brought by the government is good to hear, the six bills brought to amend 31 laws are numerically and procedurally incorrect.
