‘Borrowers and bankers should not be treated under the same law, let’s investigate bankers only if they have colluded’ – Governor Adhikari

Kathmandu. Governor of the National Bank, Mahaprasad Adhikari, has emphasized that the laws governing banks and borrowers should be different. Governor Adhikari has emphasized that the laws should be made different, saying that the situation has become such that bankers can also go to jail along with the borrowers.

Governor Adhikari expressed this view during the discussion on the Banking Offences and Punishment (Second Amendment) Bill 2080 in the Finance Committee of Parliament. During the discussion, Governor Adhikari said, ‘It is a matter for the banker to decide whether the business will run or not. The borrower will take the money, while using the law, the borrower and the banker were put in the same place. Therefore, the banker has to go to jail along with the borrower.’

Governor Adhikari has expressed the view that there should be a separate law for borrowers and bankers. The Adhikari added, ‘I cannot speak on this issue during the implementation of the law, but I should be able to speak on this issue during the formulation of the law. The borrower is the one who takes the loan, the banker’s job is only to approve the loan.’

Governor Adhikari has emphasized that the borrower and the banker should be separated. He said, ‘Only then should the banker be investigated. When the borrower says that we colluded while taking this loan, where am I the only one who is involved? If he says that we colluded while taking this loan, then the banker should also be investigated. They also have involvement. Only then should the investigation be done.’

According to the Governor Adhikari, there is currently a situation in which employees in banks do not take their pens out of their pockets. Bankers are afraid to work, saying why put themselves at risk by giving loans.

Proposal for action against those who engage in activities against banks

Governor Adhikari has proposed that those who engage in activities against banks and financial institutions should also be taken action according to banking offences. Targeting businesswoman Durga Prasai, Governor Adhikari has said that anyone who moves against financial stability should be a party to the action. He has also suggested that action be taken against such activities by enacting a law in Parliament.

Governor Adhikari said, ‘If someone has 10,000 followers on social media. He runs a campaign to not pay the bank’s loan, depositors will start lining up in a bank, which will seriously affect not only a bank or a cooperative but the entire financial sector.’ Governor Adhikari said that anyone who disrupts financial stability should be brought under the ambit of banking offences.

Governor Adhikari said that the campaign to not pay the money is still having an impact. Governor Adhikari says that there is now an opportunity to enact laws to stop such activities.
