Supreme Court upholds appointment of 52 ciaa office-bearers including Chief Rai

Kathmandu. The Supreme Court has upheld the appointment of 52 constitutional functionaries. Chief Commissioner of the Commission for the Investigation of Abuse of Authority (CIAA) Prem Rai and office-bearers of all 52 constitutional bodies will be able to serve their full term.

Supreme Court Chief Justice Prakash Man Singh Raut, Justices Sapana Pradhan Malla, Manoj Kumar Sharma and Dr. Kumar Chudal and Dr. A division bench of Justice Nahakul Subedi ruled that the appointment of 52 office-bearers was constitutional. The decision was taken by a 3/2 majority among the judges.

Earlier, the decision was scheduled to be announced on June 15. The new date for pronouncing the verdict was scheduled for June 10 as there was no preparation to announce the verdict on that day.

The then Prime Minister KP Sharma Oli had appointed 52 office-bearers in various constitutional bodies without holding parliamentary hearings when the House of Representatives was dissolved.

A total of 15 writ petitions were filed in the Supreme Court seeking quashing of the petition. The regular hearing had been going on since January last year.

The then Prime Minister Oli had amended the law through an ordinance and appointed 32 office-bearers on February 21, 2077 and 20 on July 10, 2078.

The arguments on the 15 writ petitions against the appointment had concluded on May 15, 2081 and the date for pronouncing the verdict was Fixed for June 15.

Another hearing was scheduled for Wednesday as necessary preparations had not been made to announce the verdict on June 15.

Chief Commissioner of the Commission for the Investigation of Abuse of Authority Prem Kumar Rai was placed at the centre of the verdict. Rai has been accused of filing corruption cases on the basis of political vendetta and helping KP Oli and THE UML.
