Law to provide for anticipatory bail to be introduced in upcoming Parliament session: Minister Chaurasia

Kathmandu. Minister for Law, Justice and Parliamentary Affairs Ajay Kumar Chaurasia has said that there should be no delay in granting powers to the provincial and local levels. Speaking at a program organized in Lalitpur on Thursday, he said this.

He mentioned that there should be no hesitation in granting powers to the provincial and local levels to further strengthen them. He said that Article 57 of the Constitution grants 35 sole rights to the Union, 21 and 22 to the provinces and local bodies regarding the distribution of state power.

According to the said rights, the Ministry of Law is working on making additional laws on the issue of the interrelationship between the provinces, local levels and the Union, and other ministries of the Union are also working on making related laws and are moving forward with the advice of the Ministry of Law to make better and stronger laws.

He said that although the Constitution grants the right to freedom of expression, in recent times, expressions such as falsehood and personal character assassination have been made. Is Nepali society known as the best society in the world for doing all this? He asked.

Minister Chaurasia said, ‘I also believe that. There is no need to delay any longer. The issue of giving powers to the provinces, making local bodies more powerful, should not be compromised, the Constitution of Nepal 2072 BS has envisioned a three-tier, inclusive, proportional state system, not a unitary system. And Article 57 of the Constitution has given 35 single powers to the Union, 21 and 22 powers to the provinces and local bodies regarding the distribution of state power.’

‘According to that right, the Ministry of Law is working on making additional laws on the issue of the interconnection between the provinces, local levels and the Union, and other ministries of the Union are also working on making laws related to that, and with the advice of the Ministry of Law, they are moving forward in making better and stronger laws. Whatever provisions our Constitution has made, that system is not found to be arranged in a way that includes all classes in many countries of the world.’ He added, ‘We have a system of being able to speak, but now it has become a system where whatever is said is done. People are saying whatever they get, writing whatever they get. The same is true on social media. To some extent, someone has brought a photo of them dancing, kissing and put their head on a photo of a leader. Is Nepali society going to go there? Nepali society is known as the best society in the world for doing all this.’

Minister Chaurasia claimed that a law to provide anticipatory bail in Nepal, like in other countries, will be presented in the upcoming parliament session. Now, any person can be arrested by the police administration at any time and if he is found innocent after a few days, anticipatory bail will be provided.

He said that the interconnection between the state, union and local bodies should be established and that the right to make laws necessary for each other is for the three levels, and that the government has not done anything, and the statement that the government has done nothing has been rapidly communicated.
